Terms of ServiceDraft

Last updated October 10, 2026 · Effective October 10, 2026

Please read these Terms carefully. They include a risk disclosure, limits on our liability and an agreement to arbitrate disputes on an individual basis.

1.Acceptance of these Terms

These Terms of Service (the "Terms") are an agreement between you and Select Labs LLC ("Polyquest", "we", "us"). They govern your use of the Polyquest website, app and related services at polyquest.xyz (the "Services").

By accessing the Services, creating an account, connecting a wallet or placing a trade, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Services.

We may update these Terms. The date at the top shows the latest version. Material changes are announced on the Services at least 14 days before they take effect. Continued use after that date means you accept the new Terms.

2.Eligibility and restricted jurisdictions

To use the Services you must:

  • be at least 18 years old, or the age of majority where you live, whichever is higher;
  • not be located in, a resident of, or accessing the Services from a Restricted Jurisdiction;
  • not be a person or entity subject to sanctions administered by the United States, the United Nations, the European Union or the United Kingdom, or act on behalf of one;
  • have the legal capacity to enter into this agreement.

"Restricted Jurisdiction" means any country or region where prediction markets, the trading of event contracts or the use of digital assets is prohibited or where offering the Services would require a license we do not hold. The current list is published on the Services and may change without notice. Some Polymarket markets are unavailable in additional regions under Polymarket's rules.

Using a VPN, proxy or any other method to hide your location or get around a restriction is a breach of these Terms. We may block access, close accounts and withhold winnings from accounts that do so.

3.The Services

Polyquest is a software interface for prediction markets. It lets you view markets, buy and sell outcome shares, create markets if you are an approved creator, and manage a Solana wallet. There are two kinds of markets.

Originals

Markets created on Polyquest and run by smart contracts on the Solana blockchain (the "Protocol"). Prices are set by an automated market maker. Trades, positions, payouts and refunds are executed by the Protocol, not by us.

Polymarket markets

Markets operated by Polymarket that Polyquest displays and routes orders to. These markets are governed by Polymarket's own terms, rules and resolution process. Polyquest is an independent interface and is not affiliated with, endorsed by or responsible for Polymarket.

What we are not

Polyquest is non-custodial. We do not hold your funds, keys or positions, and we cannot reverse transactions. We are not a broker, dealer, exchange, bank, money transmitter or investment adviser, and we do not give financial, legal or tax advice.

4.Accounts and wallets

You can use the Services by connecting a Solana wallet you control, or by logging in with an email address. Email login creates an embedded wallet for you through a third party wallet provider. You can export the private key of that wallet at any time.

You are responsible for everything done with your wallet and your login credentials, including keeping private keys, seed phrases and login codes secret. We never ask for them. We cannot recover lost keys or reverse transactions signed by your wallet.

You may hold one account. You may not share, sell or transfer an account, or use the Services on behalf of someone else without our written permission.

5.Funds, deposits, swaps and pUSD

Deposits are transfers to your own wallet on Solana. Funds sent on another network cannot be recovered by us.

Swaps are executed through third party routing protocols on Solana. Quotes include their fees and the price impact of the trade. The executed price can differ from the quote within the slippage limit you set.

"pUSD" is the balance you use to trade Polymarket markets through Polyquest. It represents USD value held in a Polymarket trading account that is linked to your wallet and that only your wallet can sign for. Deposits to and withdrawals from pUSD involve conversion and bridging by third party protocols, whose costs and timing are shown before you confirm. pUSD is not a deposit with us, is not insured and is not a token you hold on Solana.

Blockchain transactions require a network fee paid to the network, not to us. Transactions that fail for lack of a network fee, slippage or network congestion are not charged except for the network fee.

6.Trading rules

  • On Originals, shares of the winning outcome are paid from the market pool at a payout per share that is fixed at resolution and shown on the market page. That payout is not necessarily one unit of the market token. On Polymarket markets, each winning share is worth 1 pUSD. Shares of any other outcome are worth nothing.
  • Prices shown before you confirm are estimates. The executed price is determined by the Protocol or by Polymarket at execution time.
  • Trading on a market stops at its end date. Open orders on Polymarket markets are cancelled when the market closes.
  • Fees are shown on the ticket before you confirm. See the fee schedule.
  • All transactions are final once confirmed on chain. We cannot cancel, reverse or modify them.

7.Resolution, refunds and finality

Originals are resolved by the market creator according to the rules and the resolution source published on the market page. The creator submits the result after the end date, and the result is final once submitted. We do not verify, approve or guarantee results, and a creator may resolve a market in a way you disagree with or that does not follow the stated rules or source. You accept this risk when you trade an Original. Once a result is final, winning positions can be claimed from the Protocol at the payout per share fixed at resolution.

A dispute process, under which a submitted result may be challenged for a set period before it becomes final, is under development. When it is available, these Terms and the Help Center will describe it, and it will apply only to markets that resolve after it launches.

We may revoke a market when it cannot be resolved fairly, including when the event is cancelled, the rules do not cover what happened, the source is unavailable, or the market breaches these Terms. When a market is revoked, each position is refunded automatically by the Protocol: you receive the amount you paid for it, in the market token, and no claim is needed. Fees already paid are not refunded.

Polymarket markets are resolved by Polymarket under its own rules. We display the result and cannot change it. Disputes about those markets must be raised with Polymarket.

Creators are expected to resolve in good faith on the information available, but we do not check that they do. You accept that resolution involves judgment and that a final result will not be reopened.

8.Creating markets

Market creation is available to approved creators. Anyone may apply from the Services; we review applications and may approve, decline or later withdraw creator access at our discretion. By creating a market you confirm that:

  • the question can be resolved from public information using the source you name;
  • you will submit the result within 48 hours of the end date, following the rules and the source you named;
  • you will not trade on non-public information about the outcome;
  • the market does not fall into a prohibited category.

Prohibited markets

You may not create markets about: death, injury or harm to any person; violence, terrorism or war casualties; crimes against a person; private individuals or anyone under 18; hate, harassment or discrimination; anything that is illegal where the market is offered; or anything that would require a license we do not hold. We may remove or revoke any market at our discretion.

Creating a market requires seed collateral, which is locked in the market pool at creation. Part of the seed can be lost to traders; the maximum loss is shown in the creation form before you confirm. You set the creator fee for each market between 0.1% and 5% of every trade (1.0% by default). The fee is taken by the Protocol on each trade and paid to you as the creator. Creator access can be withdrawn for breaches of these Terms.

9.Fees

Fees on Originals consist of the creator fee, set for each market by its creator between 0.1% and 5% of every trade (1.0% by default) and taken on every trade by the Protocol. Fees on Polymarket markets are Polymarket's own and are shown on the ticket. Swaps, bridging and network transactions carry third party costs shown before you confirm. We may introduce or change fees with notice on the Services. Fees are not refundable.

10.Risk disclosure

Trading on prediction markets is risky. Before using the Services you should understand and accept the following.

  • You can lose everything you put in. Shares of an outcome that does not win are worth nothing.
  • Prices move quickly. Markets react to news in seconds. The price you see may not be the price you get.
  • Liquidity varies. Thin markets have large price impact and may not let you exit at a fair price. There is no cap on price impact at present, so a large trade can move the price a lot.
  • Smart contracts can fail. The Protocol and the third party protocols we route through may contain bugs or be exploited. Funds in them may be lost.
  • Digital assets are volatile. The value of the tokens you hold, including the market token of a position, can fall independently of the market outcome.
  • Resolution involves judgment. Originals are resolved by their creator and we do not verify, approve or guarantee results. A market can resolve against your expectation, including in a way that does not follow its stated rules or source, or be revoked.
  • Creating a market puts collateral at risk. Seed collateral is locked in the pool and part of it can be lost to traders, up to the maximum loss shown when you create the market.
  • Third parties. Polymarket, wallet providers, bridges and swap routers are outside our control and may be unavailable, change terms or fail.
  • Regulation. Laws on prediction markets and digital assets vary and change. The Services may become unavailable where you live.
  • Taxes. You are responsible for any taxes that apply to your trading.

Nothing on the Services is a recommendation to buy or sell anything. Only trade with funds you can afford to lose.

11.Prohibited conduct

You agree not to:

  • manipulate any market, including wash trading, spoofing, coordinating trades to move prices, or trading on non-public information;
  • interfere with resolution, including resolving a market you created against its rules, giving false information about an outcome, or pressuring creators or other users;
  • use bots or scripts that overload the Services or gain an unfair advantage, beyond any published API limits;
  • circumvent geographic or other access restrictions;
  • use the Services to launder money, finance terrorism or evade sanctions;
  • impersonate anyone, scrape user data, or post content that is illegal, hateful, harassing or infringing;
  • attack, probe or reverse engineer the Services other than through our published security disclosure process.

12.User content

Markets, rules, comments, display names and other content you submit are yours, but you grant us a worldwide, royalty free license to host, display and distribute them as part of the Services. You are responsible for your content. We may remove content that breaches these Terms or that we reasonably believe is harmful, without notice.

13.Intellectual property

The Services, including the Polyquest name, logo, design and software, are owned by Select Labs LLC or its licensors and protected by intellectual property laws. You may use the Services only as these Terms allow. Open source components are licensed under their own terms. Polymarket is a trademark of its owner and is used only to identify the markets routed to it.

14.Third party services

The Services depend on third parties we do not control, including the Solana network, Polymarket, wallet providers, swap routers, bridges, data providers and streaming services. Their availability, terms and fees are theirs. We are not responsible for their acts, omissions, outages or losses they cause. Links to third party sites are provided for convenience and are not endorsements.

15.Suspension and termination

We may suspend or end your access to the Services at any time, with or without notice, if we reasonably believe you have breached these Terms, if required by law, or to protect the Services or other users. Because the Services are non-custodial, suspension does not affect funds in your wallet or positions held by the Protocol, which you can still access directly on chain. You may stop using the Services at any time. Sections that by their nature should survive, including risk, disclaimers, liability, indemnification and governing law, survive termination.

16.Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Services will be uninterrupted, error free, secure or accurate, that prices or data are correct, or that any market will resolve in a particular way. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

17.Limitation of liability

To the fullest extent permitted by law, Select Labs LLC and its officers, directors, employees, contractors and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, digital assets or goodwill, arising out of or related to the Services, however caused and under any theory of liability. Our total liability for all claims relating to the Services will not exceed the greater of USD 100 or the fees you paid to us in the twelve months before the claim arose.

Nothing in these Terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

18.Indemnification

You will defend, indemnify and hold harmless Select Labs LLC and its affiliates, officers, employees and agents from any claims, damages, losses and expenses, including reasonable legal fees, arising out of your use of the Services, your content, your breach of these Terms or your violation of any law or third party right.

19.Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules.

Before starting a formal dispute, you agree to contact us at help@polyquest.xyz and try to resolve it informally for 30 days. Any dispute that is not resolved will be settled by binding arbitration administered by the American Arbitration Association under its rules, on an individual basis. Class actions and class arbitrations are not permitted. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms. Either party may seek relief in small claims court for qualifying claims.

20.General

These Terms, with the Privacy Policy and any market rules, are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. Notices to you may be posted on the Services or sent to the email on your account.
